Here is what I want from you.
We must have justice in our society. My personal income is 12,000 p.a. and I spend 24,000 to feed myself and maintaqin a freehold house and motor car. Of course I understand that it is not your role to find me a job, but the government really must face the truth, and understand that I own intellectual property which could earn me over a million New Zealand dollars an hour.
At present I cannot take my case to court, because Guardian Trust have placed themselves in legal responsibility of my affairs.
I am capable of managing them myself, and do not need someone to pay my electricity account, my telephone account and my rates for me. They have charged me $50,000 to do this since 2,000 and they have prevented me from buying a freehold house for $50,000, an investment which would have paid for itself in five years and now been an asset worth $100,000 more.
Guardian Trust say I am non compos mentis in a legal sense. Do I appear that way to you? While I can work in the kiwifruit indistry easily, it does not resolve these unresolved issues which fester and smolder.
We could easily discuss some of the concrete things you can help me with and I hope you will arrange a meeting so that we can do that.
Malcolm Baker.

Dear Sir,
It has been a hectic time for me since you received my last letter.
I'm asking you again for your assistance, and wonder if you really understand or care about my situation, as one of your constituents. Really I am not a lone voice, because I go to a Christian Church, St John the Baptist, most if not every week, as did my mother and her sister my aunt. Both were married in church, and their children were christened there. We all celebrate Christmas as a family, and there are many many honest law abiding citizens and friends who attend the same church.
Some years ago, I don't remember exactly, possibly 2005 or 2004, a mongrel mob prospect, a 17 year old Ronald McDonald) Moses and a friend broke into my house while I was asleep and attempted to murder me. At least that is what he told me. Fortunately I fought him off, and he was caught the next day by police, and was forced to pay me $500 for the damage he did to my glasses when he assaulted me with a chain attached to a pipe.
I'm in favour of your action to force the mongrel mob to remove their patches. It may not be easy because many maori families have a child or son who is a member of teh mob, but I believe many will go to prison for rape or murder, and many children will grow up selling drugs on teh streets, and will always be in debt to the gang, which after all is just a tool of organised crime, the mafia gangs of Italy. This is the sad reality.
Because tyeh case is before the courts I cannot say too much. On the 11th October I was walking down the street and had to walk past a small group sitting a few metres away from teh footpath. Because Maketu is a friendly community where everyone knows everyone, and because I have lived here for thirty years, and recognised some of teh children, I walked over and said hello. Surprisingly I was asked to leave, and did so immediately. Shortly after, as I was driving down the street , a man ran out in front of me and threw a rock at me windscreen, then assaulted me through my open drivers window, striking me with his closed fist on my cheek.
After driving home, and settling my nerves, and having three or four glasses of wine to help me do this, I telephoned the police who came to my home and arrested me for two counts of indecent assault on a child under teh age of 12, and for drink driving.
I completely deny both or all charges. I did not drive with excess alcohol in my blood, and I did not sit down, touch or in any was assault anybody, either physically or sexually. All the charges relate to the events on the 11th October which happened in less than two minutes.
As I result I have lost my drivers licence for 28 day, and must appear in court to defend myself. This is unfair. It is not illegal to drink at home, and even though it is rare for me to drink at all, I had plans to attend the Russian Ballet in Rotorua on the 16th and had bought tickets to Swan Lake months ago, and could not find a driver for my car at such short notice.
The other charges are more serious, and I have legal aid, but I could lose my house defending them if I am left with a huge legal bill. I can't say any more but you should look at this situation seriously. I am innocent of all charges, and it is very inconvient to be forced to catch a bus every time I need to go to town or to church.
You may have heard that I am mentally ill?
This is not the case, as qualified doctors have stated in writing.
In a leter dated 11th August 1992 the manager of Tokonui Hospital, a qualified Psychiatrist, Dr Van Der Sluis said he, at that time "could not confirm" that I had any mental illness, specifically schizophrenia, because I had been evaluated by them previously, and found sane and rational, and despite being categorized as being under the mental health act, a patient on leave, it was merely an statutory requirement.
This was confirmed by Dr James Short on 27th April 1993 who released me from the mental health act saying he could not find any signs of mental illness.
The then District Inspector of Mental Health David Bates instigated a full enquiry at the time as to how I had been illegally detained, and why the police could not prosecute me for a minor trespass, but had taken me to Tokonui. No prosecutions were undertaken because at the time I did not have the financial resources to do this.
Again in 2007 an attempt was made to have me incarcerated using the provisions of the mental health act. This was at the instigation of my neighbour to whom I had sent a request for payment regarding a web browser I claim to have written for Sun Microsystems. Again the judge hearing the review on the 17th of January 2008 Judge Donovan said, there were no grounds to detain me:
"The evidence does not persuade me that either of the limbs and for
definition of mentally disordered in the Act are satisfied in this case,
I am simply not able to find evidence which would satisfy me that
Malcolm's ability to care for himself is seriously diminished. Certainly
in terms of his self-care that could not possibly be said to be the
case. It is significant that his property is being managed by the
Guardian Trust Company an order to that effect having been made under
the Protection of Personal Property Rights Act.
In all circumstances the evidence fails to satisfy me that I should make
an order today, and will not."
There is more of this type, in my Journal, the CPJ, including an alleged assault by staff while I was at Tokonui in 1992, something which was not uncommon at that time despite the lack of provocation from me, if a patient could ever provoke a physical assault with fists.
